1. Acceptance of Terms & Age Restriction

By accessing or using BanaoAI, you agree to be bound by these strict terms. You must be at least 18 years of age to use this service. If you are under 18, you are strictly prohibited from using this platform.

2. Intermediary Status (IT Act Section 79 Safe Harbour)

Under Section 79 of the Indian Information Technology Act, 2000, our platform acts purely as an 'Intermediary'. We only provide a technical interface to third-party generative AI models (such as Google Gemini). We do not manually monitor, filter, endorse, or claim ownership of the inputs you provide or the media generated. You are the sole publisher and are exclusively responsible for your creations.

3. Absolute Prohibition on Illegal Content & Deepfakes

This platform operates with a ZERO-TOLERANCE policy for misuse. You legally bind yourself NOT to create, upload, or attempt to generate:

• Deepfakes & Morphing: Any manipulated media of politicians, celebrities, or private individuals without their explicit written consent.
• NSFW & CSAM: Sexually explicit content, pornography, or Child Sexual Abuse Material (CSAM). Generating CSAM will result in immediate reporting to authorities.
• Hate Speech & Violence: Content that promotes terrorism, religious hatred, communal violence, or political misinformation.

4. Data Retention & Third-Party APIs (14-Day Policy)

By using this service, you explicitly consent to your text prompts and media inputs being securely sent to third-party APIs (such as Google Gemini). These external APIs retain your data and generated outputs on their servers for a mandatory period of up to 14 days for operational and Trust & Safety monitoring before permanent deletion. BanaoAI is not liable for data breaches or policies of these third-party servers.

5. Indemnification (Your Financial & Legal Liability)

You agree to completely indemnify, defend, and hold harmless BanaoAI, its owners, partners, and employees from any claims, damages, lawsuits, police complaints, or legal expenses (including attorney fees) arising directly or indirectly out of the content you generate, your violation of these terms, or your infringement of any third-party rights.

6. Law Enforcement Co-operation

We strictly log your IP Address, account details, timestamps, and prompt history. In the event of an investigation by Cyber Crime Police or other legal authorities regarding illegal activities, we will unconditionally share your complete data to assist law enforcement without prior notice to you.

7. Payments, Tokens, and No-Refund Policy

We operate on a pre-paid Token wallet system. All token purchases are final and strictly non-refundable to your bank account, credit card, or UPI. If an AI generation fails due to API timeouts or server errors, the deducted tokens are automatically refunded solely back to your platform wallet. We hold the right to permanently ban accounts and forfeit tokens without refund if illegal activity is detected.

8. Governing Law & Jurisdiction

These terms shall be governed by and construed in accordance with the laws of India. Any and all civil or criminal disputes arising out of or related to the use of this platform shall be subject to the exclusive jurisdiction of the competent courts in India.

9. Grievance Redressal & Takedown Policy

In accordance with the Information Technology (Intermediary Guidelines) Rules, 2021, if any person finds content generated on this platform that violates their privacy, infringes copyright, or is a deepfake, they may contact our Grievance Officer. We will act within 24-36 hours to disable access to such illegal content.
